What changed?

 

Clarification is added that Good Cause (good faith effort) can be granted when applicants/participants are unable to provide a photo identification (ID) in person due to district office closures associated to the novel coronavirus (COVID-19).

Policy

Applicants must provide photo ID (In Person) at the time of application or when a request to add an adult to the Assistance Unit (AU) is received.  This includes:

 

·          

Each aided or non-aided parent (natural and adoptive parents and aided step-parents) and/or non-parent caretaker relative of an aided child(ren), or of an excluded child who receives Supplemental Security Income/State Supplementary Payment or Foster Care payments; and

·          

A pregnant woman applying for or receiving aid for herself only.

 

This requirement applies regardless of citizenship or legal status for living in the United States (U.S.).

 

Exceptions

 

·          

Applicants who already have a photo ID on file and non-needy caretaker relatives of children in Foster Care are exempt from the photo ID requirement; and

·          

Persons making a good faith effort to provide the information will be given additional time to meet the photo ID requirement.  This includes situations in which the district offices are closed due to health concerns associated to the novel coronavirus (COVID-19). 

 

Immediate Need (IN)

 

IN payments can be issued pending receipt of the photo ID.

For purposes of this release, reference to CalWORKs also refers to Refugee Cash Assistance cases and Trafficking and Crime Victims Assistance Program.

Background

Senate Bill 89 (Chapter 24, Statutes of 2017) repealed the use of the Statewide Fingerprint Imaging System Requirements (SFIS) as a requirement for issuing CalWORKs benefits effective June 30, 2018.  SFIS was a statewide program used in Los Angeles County to fingerprint and photo image applicants and match their records against persons throughout the State to verify identity and provide an alert to counties of potential fraud due to duplicate aid.

 

Effective July 1, 2018, as a result of the SFIS repeal, an applicant’s/participant’s fingerprints and photo images are not required to be captured as a condition of eligibility to receive CalWORKs benefits.  Instead, applicants, regardless of citizenship or legal status for living in the U.S., must provide a photo ID, in person, at the time of application or when a request to add an adult to the AU is received.

Has attempted to comply within their limits, but are having difficulty obtaining the requested document from a third party.

When an applicant’s photo ID is not on file, a telephone application interview may be conducted although the applicant will need to come to the office to provide the photo ID in person. 

 

Failure to comply with this requirement will result in ineligibility for the entire AU. 

 

Exceptions

 

Applicants will not be required to provide a photo ID in person when:

 

·          

There is an existing photo ID on file; or

·          

They are a non-needy caretaker relative of a foster child placed by the Department of Children and Family Services; or

·          

Persons making a good faith effort to provide the information but are not able to do so due to circumstances beyond their control should be allowed additional time to provide the information.

Processing Timeframes

DPSS has an internal departmental processing timeframe of 30 calendar days for CalWORKs applications. 

 

When the photo ID has not been provided, the CalWORKs application can be approved in situations when the applicant is making a good faith effort to provide it, but is unable due to circumstances beyond their control.

Can be approved as long as the applicant completes a PA 853, Affidavit, indicating why they were not able to provide a photo ID and all other conditions of eligibility have been met.  Eligibility staff must control for receipt of the verification.

Once the case is approved, the participant must provide the photo ID in person within 15 calendar days after case approval.

·          

If the participant does not provide the photo ID within 15 days of case approval, but continues to make a good faith effort, the case is not discontinued and the Eligibility staff must continue to follow up in 30-day intervals.

Is denied.

CalWORKs Application Interview

As a condition of eligibility, an interview is required for CalWORKs applicants.  The interview can be conducted by telephone or face-to-face.  When a face-to-face interview is conducted, to the extent possible, Eligibility staff should obtain the photo ID from the applicant(s) during the face-to-face interview.

Immediate Need

IN benefits can be issued to the applicant prior to providing a photo ID. 

 

When the photo ID is not provided (within the application processing timeframe), the IN issued is not an overpayment. 

Redetermination (RD)

A photo ID must be provided in person for an adult who was newly reported as part of the RD and does not already have a photo ID on file.

 

The case is discontinued if the photo ID is not provided.

Mid-Period Report

When a request is received from the participant to add a new person to the AU mid-period, the new person is considered an applicant and is subject to the photo ID requirement.

 

For Semi-Annual Reporting (SAR) AUs:

The person must be added to the AU by the first of the following month, if cash benefits will increase, otherwise by the next payment period.

Photo ID is not provided in person

The person cannot be aided, and the case must be discontinued at the end of the payment period with a ten-day Notice of Action (NOA) unless the participant provides the photo ID in person before the effective date of the discontinuance.

 

For Annual Reporting/Child-Only (AR/CO) AUs:

The person must be added to the AU by the first of the following month with a ten-day NOA regardless of whether the change results in an increase or decrease.

Photo ID is not provided in person

The person cannot be aided and the case must be discontinued at the end of the month with a timely ten-day NOA unless the photo ID is provided in person before the effective date of the discontinuance.

 

Note:  The person must be added to the CalFresh segment provided they meet CalFresh eligibility requirements.

Assist the applicant/ participant with obtaining a photo ID

Eligibility staff should assist the applicant with obtaining a photo ID if they need assistance.

Ineligible Noncitizens

Adults must provide their photo ID in person, regardless of citizenship status or legal status for living in the U.S.

 

Failure to Provide (FTP) photo ID in person

The entire AU is denied or discontinued for failure to cooperate with the ID requirements.  The effective date is based on SAR or AR/CO rules.

 

Confidentiality

SFIS information in the case record obtained prior to the 2018 repeal of SFIS on June 30, 2018, continues to be considered confidential under Section 10850 of the Welfare and Institutions Code.

 

County staff must not use or disclose the data collected for any purpose other than the prevention or prosecution of fraud.
